I am shocked and saddened to learn that the synagogue of my youth, the Young Israel of Woodmere, has invited Israeli Minister Itamar Ben Gvir to speak from its podium.

Ben Gvir has been:

– held an Animal Pride March to mock lesbians and Gays

– convicted of incitement to racism

– convicted of supporting a terrorist organization

– seen on the news proudly holding the broken car emblem of Prime Minister Rabin, saying if we can get to his car, we can get to him. Prime Minister Rabin was later assassinated.

– a member of the outlawed Kahana party and is the ideological follower of Rabbi Meir Kahana.

– seen hanging a picture of a mass murderer of Arabs on his living room wall

– accused by the Israeli Police Commissioner for inciting violence in Sheikh Jarrah

– made comments condemned by the U.S. government as racist.

I could go on, but I think you get the point.

Rabbi Heshel Billet was the rabbi who headed the YIW for decades. If my memory serves me correctly, about 40 years ago Rabbi Meir Kahana, who was then a Member of the Israeli Knesset, came to the YIW to pray Friday night.

Rabbi Billet, who is a tremendous Zionist, a major supporter and defender of Israel, and who recently made Aliyah, refused to publicly welcome Rabbi Kahana to the synagogue. It is unfortunate that the values that Rabbi Billet tried to instill in the members of the shul for over 40 years have so quickly eroded.

While shuls on the left and even on the right are refusing to give Ben Gvir a platform, the YIW is inviting him to speak. Ben Gvir was so morally repugnant that Bibi refused to have his picture taken with him until he needed him to scrape by a coalition.

I hope the shul will rescind the invitation and if it doesn’t, I hope men and women of conscience in the Young Israel of Woodmere will rise up and walk out when he speaks.

– Deliberately inflicting conditions of life calculated to bring about physical destruction: Israel has systematically blockaded Gaza, denying food, water, medicine, and healthcare. The ICJ has recognized that genocide can be committed by withholding humanitarian aid. Famine has killed over 460 Palestinians, including more than 150 children.

 Imposing measures intended to prevent births: The bombing of maternity hospitals and fertility clinics, alongside widespread reproductive violence, has had a “significant impact on women and babies/children, with an increase in miscarriages”.

Specific Intent: The Statements That Prove Genocide

The most challenging element of proving genocide is establishing the “dolus specialis”—the specific intent to destroy a group. However, public statements by senior Israeli officials provide compelling evidence of this intent:

– Yoav Gallant (former Defense Minister): Announced a “complete siege” of Gaza City, declaring there would be “no electricity, no food, no fuel” and that “everything is closed.” He also stated to Israeli troops: “We are fighting human animals… Gaza won’t return to what it was before. There will be no Hamas. We will eliminate everything”.

– Isaac Herzog (President of Israel): Declared that “it is an entire nation out there that is responsible,” effectively designating all Palestinians as legitimate targets.

– Israel Katz (Energy Minister): Ordered that “all the civilian population in Gaza is ordered to leave immediately. They will not receive a drop of water or a single battery until they leave the world”.

– Bezalel Smotrich (Finance Minister): Has openly envisioned the “total destruction of Gaza” and the concentration of the Palestinian population in a small “humanitarian zone”.

– Itamar Ben-Gvir (National Security Minister): Declared that “All of Lebanon must burn!” and has spearheaded Israel’s new death penalty law mandating execution for Palestinians. He was recently filmed forcing down the head of a bound Gaza flotilla activist and shouting in Hebrew “Shut up!” into her face.

Under international law, this combination of genocidal statements by state leadership and corresponding attacks on the targeted group can establish genocidal intent. The ICJ has repeatedly cited these statements in its provisional measures orders.

Crimes Against Humanity and War Crimes

Beyond genocide, Israel’s leadership faces charges for:

– Starvation as a method of warfare: The ICC arrest warrants for Netanyahu and Gallant specifically cite starvation as a war crime. The laws of war require the provision of humanitarian aid in a timely and sufficient manner—this is not occurring in Gaza.

– Forcible transfer of population: The ICJ’s July 2024 Advisory Opinion found that Israel’s transfer of settlers to the West Bank and East Jerusalem, as well as its maintenance of their presence, violates Article 49 of the Fourth Geneva Convention. Smotrich has openly threatened to destroy Palestinian communities, including Khan al-Ahmar.



– Apartheid: The ICJ found that Israel’s legislation and measures impose a “near-complete separation in the West Bank and East Jerusalem between the settler and Palestinian communities,” constituting a breach of Article 3 of the Convention on the Elimination of Racial Discrimination. The ICC is reportedly preparing charges of apartheid against Smotrich and Ben-Gvir, which would mark the first-ever international prosecution for this crime.

 Persecution, murder, and other inhumane acts: The ICC’s warrants against Netanyahu and Gallant include these charges.


The Architects of Annihilation: Individual Accountability

Benjamin Netanyahu (Prime Minister)

The ICC issued arrest warrants for Netanyahu in November 2024 for crimes against humanity and war crimes, including using starvation as a method of warfare, murder, and persecution. Netanyahu has intensified the military campaign and announced plans to resettle the Palestinian population—statements that further bolster the genocide case.

Yoav Gallant (Former Defense Minister)

Also subject to ICC arrest warrants. Gallant’s “human animals” and “complete siege” statements have been cited repeatedly by the ICJ as evidence of genocidal intent.

Itamar Ben-Gvir (National Security Minister)

The Hind Rajab Foundation’s complaint details how Ben-Gvir has overseen the transformation of Israel’s prison system into “a network of torture camps” where abuse and sexual violence are routine. He has “personally participated in instances of torture and cruel or inhuman treatment.” Reports indicate the ICC prosecutor’s office has submitted secret warrant requests against Ben-Gvir on charges that may include apartheid.

Bezalel Smotrich (Finance Minister)

Smotrich is expected to face ICC arrest warrants on charges including “forcible transfer of population,” “transfer of Israeli population to an occupied territory,” “persecution,” and “apartheid”. He lives in an illegal West Bank settlement and has been sanctioned by the UK, Canada, Australia, New Zealand, and Norway for “advocacy of the extermination and ethnic cleansing of Palestinians”.

Additional Officials

The ICC may also issue warrants for Defense Minister Israel Katz, IDF Chief Lt.-Gen. Eyal Zamir, and Southern Command Chief Maj.-Gen. Yaniv Asor.

The Obligations of Third States: Why the U.S. Must Act

States party to the Genocide Convention have an obligation to prevent and punish genocide. The ICJ has held that the obligation to prevent arises with “serious risk” of genocide—a threshold that was met in January 2024 when the Court first issued provisional measures.

Obligation to Prevent

The United States, as a state party to the Genocide Convention, has a duty to take action to prevent genocide. Given its “close relationship with Israel,” the U.S. has “significant impact to prevent genocide (e.g., by stopping the sale of arms to Israel)”. Continued arms transfers, as the International Commission of Jurists has stressed, may constitute complicity in international crimes.

Obligation to Punish

The requirement to punish genocide “can be carried out by third states through prosecuting offenders in their domestic courts”. The ICJ has held that the obligation to punish “includes a duty to cooperate with international courts and tribunals, including through extraditing offenders under an arrest warrant by those courts”.

The Hind Rajab Foundation’s complaint to the U.S. Department of Justice is grounded in this obligation. The U.S. has jurisdiction to arrest and prosecute Ben-Gvir during his visit to New York City—and indeed, has a legal duty to do so. As the IAGS resolution emphasizes, “silence in the face of such crimes amounts to complicity”.

  • Haaretz noted that 82% of Israeli Jews supported the forced displacement or expulsion of Palestinians from the Gaza Strip. [123]
  • Military Extremism: In that same survey, 47% of Israeli Jewish respondents agreed with extreme biblical interpretations of warfare regarding the total elimination of inhabitants in enemy territories.

  • Daniel Rolando Sanchez Estrada: 30 years
  • Benjamin Hanil Song: 100 years
  • Elizabeth Soto: 50 years

Ines Soto will be sentenced on July 1, along with Joy “Rowan” Gibson and Rebecca Morgan, who took non-cooperating plea deals, and five defendants who took cooperating plea deals.

Song, the most harshly sentenced Prairieland defendant, having received a 100-year prison term, gave a moving statement in response to their sentence, explaining for the first time the motivations for their actions the night of the noise demonstration at the Prairieland ICE Detention Center. “What we all saw happen to Renee Good and Alex Pretti is my worst nightmare,” said Song. “So, when I was standing in the street on July 4th, 2025, in plain view with reflective safety strips and high visibility clothing, what I saw right in front of my eyes was my worst nightmare,” continued Song. “When I saw Lieutenant Thomas Gross stop pursuing and point his gun at the back of a running, unarmed protester, like he testified, I was terrified.”

“As a firearms instructor and a United States Marine Corps Veteran, I understood what I was seeing. I knew what it meant for someone to lean forward into a gun, […] to prepare for recoil. As the evidence shows, I did not want to hurt anyone. I never had the intent to hurt anyone. It is impossible to say that I was trying to ambush or anyone or planning violence,” Song told the court. “I am so grateful that we are not here mourning another death and tragedy. Another Alex Pretti. Another Renee Good.”

“This case has relied on lies and misinformation from the start,” said Amber Lowrey, the sister of Savanna Batten, who was sentenced today to 50 years in prison. “While these absurd sentences are no surprise based on the bias of the court, it is heartbreaking nonetheless. But we will keep fighting to overturn these unjust convictions and to free Savanna and all the Prairieland defendants. We will not rest until they are free!”

“As a congregation, we decided that this case was a fundamental test of our right to dissent against authoritarian regimes,” said Ana Marie Thorne, Chair of the Social Justice Committee at All People’s Church Unitarian Universalist in Fort Worth. “These defendants are not militant monsters out to kill,” continued Thorne. “They are everyday people who saw our country literally interning people in concentration camps and decided to show up at Prairieland Detention Center to let those incarcerated there know that they mattered. We leave here today knowing that the outcome of this trial is not the end. It is the beginning.”

Before the sentencing, Judge Pittman dismissed numerous motions to overturn the convictions without providing written rulings and with little-to-no explanation. All nine trial defendants filed motions for a new trial, detailing how the government failed to provide the necessary evidence for a conviction and instead put on a trial that was “saturated with evidence designed to evoke fear, political bias, and guilt by association,” according to one of the motions. Another motion details potential juror misconduct. Prairieland defendants have vowed to fight their convictions and will be filing appeals in the following weeks.

The Prairieland cases, involving 22 people charged with both state and federal charges, stem from a noise demonstration in solidarity with detainees at the Prairieland ICE Detention Center in Alvarado, Texas, on July 4, 2025. After the protest, an officer with the Alvarado Police Department became involved in an exchange of gunfire soon after arrival. The officer allegedly sustained minor injuries, and was reportedly released from the hospital shortly afterwards, but authorities have never provided hospital records to justify these claims. Alvarado police arrested ten people that night, and a dozen more were arrested over the following several months.
